Terms and Conditions for Domestic Tours

All correspondence relating to tours, travel services, and bookings should be addressed to M/s. Memorable India Journeys Pvt. Ltd.

Booking:

Once your booking is confirmed, you enter into a contract with M/s. Memorable India Journeys Pvt. Ltd. The contract becomes binding the moment we confirm your tour or travel services in writing and receive the deposit amount from you.

Payment:

For the services contracted, a minimum deposit of 25% of the total cost is payable to M/s. Memorable India Journeys Pvt. Ltd. This deposit is required to hold the booking on a confirmed basis.

Balance Payment:

The balance amount must be paid no later than 15 days before the start of services. Any booking made within 15 working days of the service start date will be treated as a late booking, and the full and final payment must be cleared at the time of booking itself.

Note

In addition to the above, full payment must be made at the time of booking for special train journeys, and for hotel or resort bookings during peak periods such as Christmas, New Year, the Pushkar Fair, Diwali, and other high-demand festivals.

Modes of Payment

Clients may settle payments using any of the following methods:

  • Cheque or Demand Draft
  • Bank Transfer
  • QR Code

Note

  • All payments must be made free and clear of any withholding tax or deduction.
  • Any bank charges arising from the remittance (whether levied by the remitting bank or an intermediary bank) will be borne entirely by the
    payer.
  • Where payment is made through a QR code using a credit or debit card, any applicable bank charges will be borne by the payer.

Special Note

Please be aware that no employee or agent of our company will ever ask you for your net banking login, password, OTP, or similar credentials. Nor will anyone from our team ask you to transfer funds to a personal account or to install third-party applications such as AnyDesk, TeamViewer, or similar tools.

Do not act on any such request. If you come across such an incident, please report it to info@memorableindia.com without delay.

Cancellation, No-Show and Early Departure Policy

Any cancellation of tour or travel services, whether for avoidable or unavoidable reasons, must be communicated to us in writing. Cancellation charges will apply from the date we receive the written notice, and will be calculated as follows:

  • 60 days or more prior to arrival: 10% of the tour or service cost.
  • 59 to 30 days prior to arrival: 20% of the tour or service cost.
  • 29 to 15 days prior to arrival: 25% of the tour or service cost.
  • 14 to 8 days prior to arrival: 50% of the tour or service cost.
  • 7 days or fewer prior to arrival, or in case of a no-show: no refund will be made.

Additional Notes on Cancellation

  • Regardless of the cancellation slabs mentioned above, if the cancellation is initiated by the client after the booking has been confirmed with us, a minimum service charge of 10% of the total tour package cost will apply.
  • Regardless of the cancellation slabs mentioned above, if the cancellation is initiated by the company after the booking has been confirmed, the client will be offered the following two options:
  • A Credit Note will be issued for the booking amount paid, which the client may redeem at any time in the future, either personally or for use by family members, friends, or any other person they wish to nominate.
  • Alternatively, if the client prefers a refund, a minimum service charge of 10% of the total tour package cost will apply, and the remaining balance will be refunded.
  • In both of the situations above, any cancellation charges levied by the relevant suppliers, including those for tickets, hotel bookings, travel services, and guide services, will additionally be recovered from the client.
  • If you cancel your trip after it has commenced, the refund will be limited to the amount we are able to recover from the hotels, airlines, transporters, and other suppliers we work with. We do not accept any responsibility to refund unused hotel accommodation, flight tickets, transportation, missed meals, or any other services that were arranged but not utilised.
  • For special train journeys such as the Palace on Wheels, Deccan Odyssey, Golden Chariot, and Maharajas Express, a separate cancellation policy applies and will be shared with you at the time of booking.

Please also note that no refund will be made for cancellations of bookings falling within the following periods, regardless of the reason for cancellation:

  • Festival period bookings, including Diwali, Dussehra, Holi, the Pushkar Fair, and similar festivals.
  • Peak season bookings between 20th December and 15th January.
  • Long weekend bookings.
  • Cancellation charges will always be calculated on the total booking amount, not on the advance deposit alone.

Refund:

Refunds for unused or unutilised services that have been paid for and cancelled in advance will be calculated in line with the cancellation policy set out above. The refund will be released to the person who made the original payment to us. Please note that the refund process may take 2 to 4 weeks owing to standard banking procedures. If the refund is processed to a credit card or bank account, any applicable bank charges will be deducted from the refund amount.

Mandatory Identification Documents

It is mandatory for all guests, including foreign nationals, NRIs, and Indian nationals, to provide valid photo identification at the time of booking confirmation. The accepted documents are as follows:

  • Foreign nationals: a copy of the passport along with a copy of the visa is mandatory.
  • Non-Resident Indian (NRI) clients: a copy of the passport is mandatory.
  • Overseas Indian clients holding an OCI or PIO card: a copy of the passport along with a copy of the OCI or PIO card is mandatory.
  • Domestic clients: a copy of the Driving License, Voter ID, or passport is mandatory.

Arrival and Departure Policy

Standard check-in time: 1200 to 1500 hours.
Early arrival is subject to availability. To guarantee an early check-in, the room must be reserved from the previous night.
Standard check-out time: 1000 to 1200 hours.
Late check-outs may be arranged on request, subject to availability and applicable charges.

Extra Use of Vehicle

Please note that the cost of any additional use of the vehicle (cars or coaches along with the driver) is not included in the quoted services. Any use of the vehicle beyond the scheduled transfers or sightseeing is therefore not permitted.

Special Note for Helicopter Journeys

  • Helicopter tickets and fares are subject to availability and may change at any time without prior notice.
  • While Memorable India Journeys Pvt. Ltd. takes every possible care to ensure your helicopter journey proceeds as planned, sudden weather changes, VIP movements, or other unavoidable circumstances may render the service unavailable at the last moment. In such situations, we will make every reasonable effort to arrange an alternative helicopter journey on the same day or on a different date, subject to availability.
  • Tickets will not be carried forward to the next day.
  • No accommodation, meals, or transport costs incurred due to the cancellation of a helicopter journey will be paid, reimbursed, or compensated by the company.
  • For helicopter-based yatras (such as the Chardham Yatra, Teen Dham Yatra, Do Dham Yatra, Ek Dham Yatra, Vaishno Devi Yatra, or Amarnath Yatra), a separate cancellation policy applies and will be shared on a case-by-case basis.

Our Liabilities and Limitations

Please note that once the tour cost has been finalised, any subsequent increase in monument or museum entrance fees, taxes, fuel prices, or guide charges introduced by the Government of India will be charged as an extra.

  • Memorable India Journeys Pvt. Ltd. rates are based on the prevailing tariffs negotiated by us with hotels, airlines, and other partners. Hotels and airlines reserve the right to revise their rates without prior notice. In the event of such revisions, the rates quoted by us before the change may be adjusted in line with the modifications announced by the hotels or airlines.
  • Memorable India Journeys Pvt. Ltd. and its associates act solely in the capacity of an agent for the hotels, airlines, transporters, railways, and other contractors providing services. All exchange orders, receipts, contracts, and tickets issued by us are subject to the terms and conditions under which these services are offered by the respective service providers. The tickets, coupons, or passage contracts used by the carrier, hotel, or any other contractor providing services will constitute the sole contract between the client and the said contractor.
  • Memorable India Journeys Pvt. Ltd. itineraries are sample itineraries, designed to give you a general idea of the likely schedule for your trip. A range of factors, such as weather, road conditions, and the physical ability of participants, may require changes to the itinerary either before the tour begins or while it is underway. Memorable India Journeys Pvt. Ltd. reserves the right to amend any part of the itinerary, including transportation and accommodation, without prior notice, in the interest of the trip and the safety, comfort, and general well-being of participants. No rebate, allowance, or refund will be offered in such cases, and any additional cost arising from these changes will be payable by the client.
  • Memorable India Journeys Pvt. Ltd. shall not be held responsible for any delay or change in the programme, or for any expense incurred, special or consequential loss, injury, or damage (whether direct or indirect) caused by natural hazards, flight cancellations, accidents, breakdown of machinery or equipment, breakdown of transport, weather, sickness, landslides, political closures, acts of God, perils incident to the sea, floods, fire, acts of any government or other authority, wars, civil disturbances, riots, theft, pilferage, epidemics, quarantines, medical or customs regulations, defaults, or any other cause beyond our reasonable control, including any untoward incident. The client shall be liable for any additional expense incurred as a result of the situations described above.
  • Memorable India Journeys Pvt. Ltd. shall not be liable to the client or their legal representative for any loss of property or damages arising from death, injury, or loss of services that the client may suffer as a result of any act, negligence, or default by any transport company, hotel, agent, or other service provider, or by their agents or employees, or while engaged in any tour, transport, or other service. This includes, without limitation, claims arising from the ownership, maintenance, use, operation, or control of any automobile, bicycle, boat, motorised vehicle, or other common carrier, whether or not due to negligence. Clients using sporting equipment, bicycles, sailing boats, scuba diving gear, or similar items hired or supplied by hotels or rental agencies do so entirely at their own risk.
  • Memorable India Journeys Pvt. Ltd. does not carry any insurance policy that covers expenses arising from accidents, sickness, loss due to theft, or any other circumstance. Visitors are strongly advised to arrange suitable travel insurance in their country of residence. All baggage and personal property remain at the client’s own risk at all times.
  • Memorable India Journeys Pvt. Ltd. reserves the right to cancel any service if it considers that the tour, trip, or passage is impracticable for any reason, or if circumstances warrant such action. In such cases, the value of the cancelled service will be refunded to the client, who shall have no further claim against the company on this account.
  • Memorable India Journeys Pvt. Ltd. reserves the right, at its sole discretion, to decline to carry out its contract with any person it considers undesirable, without being required to provide a reason for doing so.

Force Majeure

Memorable India Journeys Pvt. Ltd. (the company), together with any of its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, or suppliers, and their respective successors, heirs, and permitted assigns, shall not be held responsible or considered in default for any failure or delay in performing any of its obligations under these terms, in whole or in part, where such performance is rendered impracticable by acts of war (declared or undeclared), sabotage, embargo, acts of terrorism, riots or other civil commotion, transport failures, acts of any government, court, or administrative authority, acts of God, fire, explosion, flood, earthquake, strike, pandemic, epidemic, outbreak of disease, quarantine restrictions, or any other cause beyond the reasonable control of Memorable India Journeys Pvt. Ltd. (collectively, “Force Majeure”).
Both the company and the client shall use their best efforts to avoid, mitigate and offset the effects of any actual or potential Force Majeure event. Once the cause of the Force Majeure ceases, the terms and conditions set out herein shall once again become fully operative.

A Force Majeure event will not, however, relieve either Memorable India Journeys Pvt. Ltd. or the client from obligations that had already accrued before the Force Majeure event occurred.

Jurisdiction Clause

All disputes arising out of this agreement, or any subsequent agreement related to it, shall be subject to the exclusive jurisdiction of the courts of Delhi only.

Special Notes

  • Terms and conditions for tours to the Andaman & Nicobar Islands and Lakshadweep Islands are separate and will be shared on a case-by-case
    basis.
  • Terms and conditions for group bookings are separate and will be shared on a case-by-case basis.
  • Terms and conditions for helicopter yatras (such as the Chardham Yatra, Teen Dham Yatra, Do Dham Yatra, Ek Dham Yatra, Vaishno Devi Yatra, Amarnath Yatra) and any other helicopter-based tours are separate and will be shared on a case-by-case basis.
  • Terms and conditions for tourist or luxury train journeys (such as Palace on Wheels, Deccan Odyssey, Maharajas Express, Golden Chariot) and any other tourist or luxury trains are separate and will be shared on a case-by-case basis.
